Terms & Conditions

These Terms and Conditions ("Terms") govern the use of services and products provided by PINC Consulting ("Company," "we," "us," "our"). By accessing or using our services, you ("Client," "you," "your") agree to be bound by these Terms. PINC Consulting is a software product studio specializing in B2B software, data science, AI services, and the development and editing of iOS and Android applications.

We provide the following services:
- B2B Software Development: Custom software solutions tailored to business needs.
- Data Science and AI Services: Data analysis, machine learning, and artificial intelligence solutions.
- Mobile Application Development: Development and editing of iOS and Android applications.

All intellectual property rights related to the services and products provided by PINC Consulting, including software, code, designs, and documentation, remain the property of PINC Consulting unless otherwise agreed in writing. Upon full payment for services rendered, the Client may be granted a license to use the delivered products as specified in a separate agreement.

Payment terms will be outlined in individual project agreements or invoices. Payment is due as specified in the agreement or invoice. In accordance with EU Directive 2011/7/EU on combating late payment in commercial transactions, late payments will incur interest at the rate published in the Moniteur Belge (Belgian Official Gazette) for late payments in commercial transactions. Additionally, a fixed compensation amount of EUR 40 will be charged for recovery costs incurred due to late payment. Further recovery costs exceeding this fixed amount may also be claimed. These charges will be applied starting from the day following the due date for payment.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes business plans, data, and technical specifications.

We comply with the General Data Protection Regulation (GDPR) and other applicable EU data protection laws. We process personal data only as necessary to provide our services and will implement appropriate technical and organizational measures to ensure data security. PINC Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

We warrant that our services will be provided with reasonable skill and care. However, we do not warrant that our services will be uninterrupted or error-free.

Prices for ongoing services or maintenance agreements may be subject to indexation to account for inflation and changes in operational costs. Indexation will be applied annually, based on the consumer price index (CPI) or another relevant index, as agreed in the service agreement. The specific index and methodology will be clearly defined in the individual service contract.

Either party may terminate a project agreement with written notice if the other party breaches these Terms. Upon termination, the Client shall pay for all services rendered up to the termination date.

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium.

We reserve the right to modify these Terms at any time. We will notify Clients of any significant changes. Continued use of our services after such changes constitutes acceptance of the new Terms.
